So, I just been hit with a 400 dollar surcharge because we are short on funds to pay our expenses, this is due in part to

people paying thier fees late and (especially in my HOA) foreclosures.

Now while we have recourse to those that pay late etc as they are still in thier houses

how about the BANKS -the owners of the foreclosed properties- Should the BANKS while they are owners be paying thier  share of HOA fees??

Also as money is now getting tight for most of us- as we live on city streets in our HOA (and we pay city taxes etc)  can we drop our  landscaping company that cuts the grass on these city streets and FORCE the city to do it  (As we ARE paying city taxes)

Home owners associations have one or two favorable traits but the number of bad ones far outnumber the good. The main problem with HOAs is that some friends get together and elect one of their own to be president. Then the fun begins because we are all created but some are more equal than others. Once on top, they see to it that they control their best interest for themselves. In my opinion, I feel that all HOAs be banned period. Let the municipality take care of the code enforcement. As for the maintainance (i/e lawn and shrubbery) let the contractors win the bid through the municipality.

GREAT ???? If home owners don't get any kind of breaks and are harrased over things then why not the banks! They shouldn't be getting any kind of special treatments!

Your right HOA's should be banned because they don't care about the home owner as they do their appearances and the cash flow! All they are a pain in the butt that just wishes to take more of your hard earned money!

The owner of deed pays the dues. If the bank forclosed then i say yes they should pay. Does the assn maintain your streets or the city. Does the entire city get their landscaping paid. Sounds like the overhead is way expensive. I'm not sure how legal charging a surcharge is. Sit down and go over your bylaws and see if they cover a surcharge. If they don't, then see when this rule became an ammendment (you should have recieved notice from the board if they did )and if it was voted on by the members of the assn. or the board only. YOur bylaws are a contract that you make when you agree to buy. YOu follow the contract and they sure as blazes need to do the same. Sounds like some bad management if they are spending more than they are taking in.

I agree, ALL HOA's should be dismantled, disbanded and made totally and completely ILLEGAL everywhere.

If it is not a gated, restricted entrance community then the "city" streets are indeed property of the city and must be maintained by them. The HOA should initiate liens on the houses "owned" by the banks. That way the courts will decide if the banks were in default on the dues. I base this opinion on experience with a couple of HOAs and am not an attorney.....what does the HOA attorney suggest and is he/she any good?

You have to watch attorneys.....there are good ones and some that are just "winging" it and pretending to have in-depth expertise in many areas without having done appropriate research.

One such example are the FCC regulations that prohibit Cable company exclusivity clauses with HOAs. Some attorneys seem to think that the regulation only applies to apartment houses/complexes, but that is not true if you read the regulations or get an opinion from the FCC. It also includes "other real estate" developments.

A simple tip. Don't live in a neiborhood That has a HOA in it.

I love living here -could it be better?-sure but it could also be a lot worse. I get homesick every time the soccer season starts ! Thats all folks ! :-)
