Dear Mr. Johnson:

Thank you for contacting me regarding the regulation of medical marijuana. I appreciate hearing from you and would like to take this opportunity to respond.

On May 9, 2007, I supported and the Senate passed the Food and Drug Administration Revitalization Act (S. 1082) by a vote of 93 to 1. This legislation includes language that would require State-legalized medical marijuana to be subject to the full regulatory requirements of the Food and Drug Administration (FDA). The FDA requires all new drugs to submit a risk evaluation and mitigation strategy, which includes approval of professional labeling and requires reporting adverse events involving the drug. Currently, the Senate and the House of Representatives are reconciling the differences between S. 1082 and the Food and Drug Administration Amendments Act (H.R. 2900).

As this issue moves forward in the 110th Congress, please rest assured that I will keep your thoughtful comments in mind. Again, thank you for sharing your views with me. If you have any additional questions or comments, please do not hesitate to contact me.

I will continue to exchange emails with  Mr. Martinez and post them here. Maybe others should write him as well. I support medical marijuana, both of my parents are old, and the legal medicine they take, to put it nicely, sucks! All of their doctors have suggested off the record, that medical marijuana is safer and does not have the harsh side effects of legal man made drugs that are killing my parents. My parents refuse to break the law, they chose to take the legal drugs that put their liver into overdrive. These drugs make my father who has cancer, irritable, and not himself.

If marijuana does not have any medicinal values, then why are there synthetic man made pills like marinol. Marinol is a poor substitute! It has many side effects. I guess maybe the pharm. companies are fooling the public, they are not fooling me, what about you?

Keep On Posting Rick maybe some day others will see this too I mean how many side affects have to be listed beside them before people wake up and realize that even other countries see the GOOD about organic!! Honestly how many side affects are in common with the ones of marijuana u know munchies (so u can keep from vomiting from chemo) so You can actually eat!! and for some laziness I am no Dr. But some people could use a case of laziass for a little while especially when it comes to those that need REST!!and last but not least DRY MOUTH oh my now they might actually get hydration from it!?! OH NO sounds terrible to me :P j/k I can't think of any othere side affects!!

The fact that it makes you high is a side effect; many prescription drugs mess you up too. Pot has more uses than duct tape and should NOT be illegal. Period.

The vote to include the FDA is a BAD thing. The FDA does not support MMJ and does not regulate medicinal plants. This legislation was created to keep it illegal on the federal level.
PS I have ALS and have outlived 90% of people with ALS by choosing MMJ and risking arrest. I think I made the right choice.

You made the right choice, you are no criminal, but a patient! You are living proof that marijuana has medicinal values!
You are wrong though about the FDA's stance on medicinal marijuana, they have been pushing Florida to allow medicinal marijuana for ten years now as of this past June, fact! I can only say that I admire you. I hope you continue to make post on my blog, thank you.
I hope this never happens, but if you ever are arrested, the Jenks vs. State of Florida 1991 is your only defense for medicinal marijuana in Florida.

Thanks for the court case info and the thoughtful comments.
On April 21st 2007 the big news of the day was that the FDA dismissed MMJ, at a very convenient time, politically speaking. They are a federal bureaucracy and therefore subject to political influence.
"F.D.A. DISMISSES MEDICAL BENEFIT FROM MARIJUANA

WASHINGTON -- The Food and Drug Administration said Thursday that "no sound scientific studies" supported the medical use of marijuana, contradicting a 1999 review by a panel of highly regarded scientists.

The announcement inserts the health agency into yet another fierce political fight.

Susan Bro, an agency spokeswoman, said Thursday's statement resulted from a past combined review by federal drug enforcement, regulatory and research agencies that concluded "smoked marijuana has no currently accepted or proven medical use in the United States and is not an approved medical treatment."

stenmobarry, with all do respect, look at the source of the study. "Washington?" Washington what? Washington advocates of false propoganda? Come on, you are not meek minded! You are in fact living proof that medicinal marijuana works! Don't decide to not challenge! I support medicinal marijuana and the FDA has been pushing Florida for medicinal marijuana for ten years as of this last June, fact! Please take a minute and go to mpp.org, please. There studies are based upon government statistics, FBI, DEA, and only government agency statistics. If you want facts and not false propaganda, then check it out. Your opinion, is worth gold, even more, you are proof about the medicinal values of medicinal marijuana! Your opinion really counts, but not if you don't give it! You know first hand about the benefits, how can anyone else tell you what works best for you? They can't!

We couldn't agree more on all things MMJ. I'm a very strong and active advocate. I'm only trying to present the facts without citing every major news outlet in the country. Go here http://www.fda.gov/bbs/topics/NEWS/2006/NEW01362.html and see what the FDA released. The FDAis not our ally. They will never approve MMJ. Keep up the good work and keep the faith. It may not happen in my lifetime, but someday the people will be heard.

Who pays the FDA? I looked at the website. I believe the effects and your testomonies more than a internet published article. Seriously, do you believe what has worked for you? Or do you believe in what is in writing that your life experiences prove? The FDA is a piece of the government's chessboard, maybe more than a pawn, you are not! You did not fabricate your illness, you are living proof! I lobby for people like yourself, belief in compassion, I have it, the government, which suggest you take legal drugs are fueled by a bottom line money, and are dangerous, not fueled by compassion only greed, and not your well being.
