Sickening... this woman isn't paying for her crime, she is the  same as she was before the baby died.... just  laying in the bed watching TV and eating.... I would throw in a couple of hundred dollars to have her  a cell built.  Just to see her pay.   Maybe they should restrict her food.... EDINBURG, Texas – A nearly half-ton Texas woman charged in the death of her 2-year-old nephew will remain in her house because the county jail lacks a large enough cell or the medical resources, prosecutors said.

A state district judge on Monday agreed not to send Mayra Rosales, who weighs nearly 1,000 pounds, to jail provided she wear a global positioning system tracker until her trial.

Rosales, 27, was indicted last week on capital murder charges in the March 18 death of Eliseo Gonazels Jr. Prosecutors say the toddler was hit at least twice in the head while in the care of the bedridden Rosales.

Sergio Valdez, Rosales' attorney, did not immediately return messages left for him Tuesday.

Prosecutors said the possibility of checking Rosales into a hospital and putting her under 24-hour surveillance was ruled out due to the prohibitive cost, the McAllen Monitor reported.

Hidalgo County Sheriff Lupe Trevino has argued that incarcerating Rosales would be impossible because the county jail does not have a cell large enough to hold her or medical staff equipped to handle her medical needs.

Prosecutors allege 20-year-old Jamie Rosales, Eliseo's mother, left the toddler with his bedridden aunt even though she knew that the woman was incapable of caring for him. She faces one felony count of injury to a child, punishable by life in prison and $10,000 in fines upon conviction.

What worse is that, if convicted, they will never proceed with capital punishment because of her "disability". You're right, put her on normal prison rations, that's a good start, but in our liberal courts view, this is considered starvation and tantamount to cruel and unusual punishment.

Cruel and unusual punishment would be to hand her a bowl of jello, a grilled chicken breast and a green salad for her dinner while she has to watch other inmates dine on cheeseburgers, steaks, fried chicken and decadent desserts. I am getting a visual here of someone throwing a whole fried chicken into her room with a string attached and the closer she gets to the chicken the further they pull in the string... wonder if they could get her to follow the friend chicken all the way to a jail cell like ole ET followed the M&M Trail.

Letting this woman serve under house arrest because of her size is wrong, afterall, she was already confined to a bed before she killed the boy... so how is allowing her to remain there any sort of punishment.

Dang Move... now I got visions of banana splits dancing in my head :)

LOL. don't think she can follow to much, unless, of course, she can roll off of the bed and let momentum take over. Then, watch out!! everyone nearby, roll out!! 7.5 on the richter scale!!

If you send her up here, she may become a hero to the liberals.

Don't under estimate the power of a hungry woman Jimbo. I have a cousin Vicki... who literally broke the seat in our rental car when we visited them in California. She got in the back seat and reached up and grabbed the front drivers seat where my husband was sitting... and tried to adjust her mass ass into the back seat (looking back we probably should have rented a flat bed trailer)... she broke the seat right off the platform. My husband was livid. We had taken she and her husband to Reno with us and she broke the seat the second she got into the car. Which didn't set for a good trip with my husband tetering back and forth the whole way. Once we got to the Casino we were going to visit she complained because of how far she had to walk to the front door, so my husband dropped her off at the front and told her to wait for the rest of us... she caught wind of an all you can eat buffet and across a big casino and was literally leaving the rest of us behind trying to get to the all you can eat buffet and none of the rest of us wanted to eat. He just pointed out how ridiculous it was, that she couldn't walk the half block from the parking space to the front door but could run to a all you can eat buffet.
I suspect this person is a similar sort, she can probably get to the things she wants and expects everyone else to cater to her on things like walking or helping her up out of the bed.

By the way, this story gives a new meaning to the phrase "everything is bigger in Texas". Can you imagine what story lines would come out, if "Married With Children" were still being produced?

Oh yes, I noticed ibejim's comment...that woman would cause a 7.5 quake...I think he underestimated the magnitude...it will be a 9.0, since all buildings in a 1,000 mile radius will be flattened in 5 seconds or less. Oh yes, there will be a big tsunami along the Texas coast to the eastern coast of Canada.

Now they have issued a story from this woman's defense Attorney, claiming she is too big to of killed this poor child and that she possibly rolled over on him, crushing him. Unbelievable.
So we aren't to punish her because she claims it was an accident? This whole situation stinks.

Now if this woman didn't kill the child on purpose, she should get a manslaughter charge minimum. But I think she really should get a form of a murder charge for rolling over and crushing the poor boy.
