Just Another Brick in the Wall

This is a follow-up to my very first blog post on this site titled Due Diligence or Misguided Malfeasance. At the time I questioned whether or not the actions by the police to raid the compound and take the children from their parents was based on a solid legal basis or if they had overstepped their bounds. Today we got that answer from the Third Appellate Court of Texas. The court ruled that there was no evidence that these children were in immediate danger of physical abuse. According to Judge Andrew Napolitano, a Fox News Contributor, these children will be reunited with their families within a week.

I can't say I'm surprised by this outcome. However, my next question is about the ability of the authorities to use DNA evidence collected in this case to build cases against the men of this cult with regard to sexual battery of a minor.  Although many of the pregnant girls have been determined to be of consensual age, about half of the pregnant girls are under age.

Another question this raises is, if the fathers of these children are convicted of sex crimes against a child, will the cult take any action to prevent them from having access to children in the future.

Let's see; about half the girls are under age. Hmmmm.... Isn't that against the law? If this is indeed true, I'll have to side with law enforcement on this one. And have this "church" pay all the bills. Too many folks are trying to hide behind God to save their hides.

Yes, Vit, on this I have to agree 100%, the question though is did the law break the law in this case. If so, one would expect that any evidence obtained as a result of their illegal invasion would also become inadmissible, therefore completely destroying any case they may have of putting these sex pervs behind bars.

Actually, Jack, it isn't. Here's why:

1. An pregnant child may be pregnant by another child. This is not a crime (at least it isn't in most states). So without knowing who the father is, there is no way to confirm that Statutory Rape has taken place. This is, of course, why they took all those DNA samples, but...

2. If there was no just cause to take those kids, the evidence from the DNA samples may be considered tainted and would not be admissible in court. Similarly, if the police obtained a search warrant to raid your neighbors house, but came to yours instead. Upon entering they found a stash of stolen DVD players, they cannot use that as evidence to get a warrant to search your house, nor could it be used against you in court.
