In September, I put a Playstation 3 game system and two video games on layaway at the K-Mart on Lake Mary Blvd! All together was almost 700 dollars. I picked this up on Friday night last week. I got home, of course, the boys were thrilled and opened it up right away. Problem came when we opened the Spiderman 3 video game.

THERE WAS NOTHING INSIDE OF IT!!

So Monday morning, I call K-Mart to make sure I can return or exchange this and to know if I need anything besides the receipt and the case. After being hung up on twice, I finally got transfered to the store manager. I told her the situation, to which she replied, I am sorry mam, without a disc, I cannot exchange this!!

Oh my god, I was in complete shock. I told her I had to open it to find out if there was anything inside of it. She had the nerve to tell me I should have opened it inside the store!!!!! Who in the world would suggest that people open the merchandise inside the store so close the the holidays. Who is going to open a gift for someone else? I literally could not believe she said that...The store Manager of all people...

I had just spent almost 700 hundred dollars, why would I want to try and steal 39.99. C'mon... She told me I would be surprised what people try to do. She sort of accused me of trying to scam them over 40 dollars and of course, suggested I open the merchandise inside the store, of course it was my fault I didn't do that!!!

I am here typing this today in hopes people will think before shopping at k-mart. Granted, it is only 40 dollars, but more of the point behind it.

I am curious if anyone else has had this issue with any store, not just k-mart. I know Wal-mart will exchange it for the same video game.

If you had a problem similar to this, what did you do? I managed to get the information to corporate, and the game distributor, but have not had any luck yet.

Please let people know, if anything, maybe I can supress their money making for screwing people over through the holidays!!

DISPUTE this on your credit card. If you didnt use a credit card, shame on you. I say that because that is your ONLY protection these days. I pay cash for NOTHING :(

I could, but how can they do that when all of my payments were like 145.00. That one game was only 39.99. I don't so much care about the 40 dollars, more of just the point of it! It was only part of the 700 hundred, but it was all paid together.

It is a sad fact that this is where our country and society is headed. We cannot trust one another anymore and don't ever try to say hi to someone. I was at a BJ's wholesale club not too long ago and when I grabbed a cart in the cart return in the parking lot it had a brand new bottle of some teeth whitener in it. As I walked into the club I gave it to the employee at the door and he looked at me like "why are youturning this in and not keeping it"? It was a sad reminder of where we are headed. The worst part bout your situation is that your son is the one who lost out and K Mart had an opportunity to make it right and didn't....no lesson learned for him.

Exactly, I am so upset about this. I have contacted corporate, and the game distributor, hopefully one of them can do something!!! I am hoping this can warn some people to open all of their merchandise, while still in the store. That woman told me it was my fault because I did not open it in the store. Me and my b/f planned it all out. We will go into k-mart pile up two carts full of games, movies and whatever else looks great, open them all up at the register, then oops we forgot our wallets! then come back and return the entire system, take my 700 dollars and but it somewhere else. Maybe that will help them realize!! ugh!

Take it up there and tell them you are going to call Tom Sussi if they don't give you a refund or the game you paid for. Over the phone does not work you have to go in the store and raise h_ll. Make sure you have all of your receipts.

This makes me mad, I'll go with you....lol. You pay for something over time to make your kids happy and they pull this BLEEP. It's ridiculous.

I think you may be onto something there. Talk to the store manager in person, and tell him if you do not get satisfaction for the missing disc, you will return all 700 bucks worth of merchandise, minus the 40 bucks, and then go re-purchase it at Wal-mart! If that doesn't light a fire under his ass, then do it!
And then tell them you will NEVER shop in thier store again!
This could be a case of someone at the distributer pocketing discs and wrapping empty boxes with the cellophane. I wonder how many empties are out there?

definitely go to the store and talk to this incompetent moron in person. (If they even speak enough English to understand you). I agree with what Frank said. Go there and make lots of noise. Then contact whomever is above the store manager and make more noise. This has me pissed off just reading about it.

LOL, I have emailed tom sussi to see what he can do. This is right down the street from fox, so hopefully he can make a difference this christmas. My son was really hurt when it was not in there, and he was upset when I told him why I could not get the game replaced! Broke my heart! I will get this game replaced or my money back, I am extremely persistant with acts of integrity... they have no right to do this...
