It continues to amaze me - no, sicken me - how Homeowner's Associations, Condominium Associations and Landlords ignore the rights afforded to our citizens through Florida Statutes.  (See, Fla. Stat. ยงยง 720.304(2) & (3), 718.113(4) and 83.67).  These statutes specifically allow homeowners, condominium owners and tenants to display a US flag, regardless of these groups' attempts to prevent otherwise by passing "anti-decoration" provisions.  I hope Brandon Davis is able to find an attorney who will help him enforce his rights and stick it to his homeowner's assoc.  As far as I'm concerned, he earned the right to fly the US flag outside his door.

You may be right I am unfamilar with the issue here but I do not believe you have to earn the right to fly the U.S.Flag.

I truly believe you are born with this right through your American Citizenship and existing Florida Law

According to the story this morning, his flag was First CONFISCATED by a Security Guard, then returned TO him upon Demand..He then mounted his, what looked to be a 12"X 8", flag again only to find it later laying on the ground broken and desecrated..

THIS man was reported to be a Member of the National Guard who wanted to fly his flag in tribute to his comrades-in-arms, both Living and Dead..

Upon discovering his flag a second time and in accordance with the guidelines regarding such treatment, He BURNED the Flag..

My question ,, WHO gave a Security Guard the POWER to Confiscate Private Property in Violation to the Constitution???

Looking: Clearly, nobody has to earn the right to fly the U.S. Flag; it was more of a rhetorical statement on my part.

Hawkeye: Good question! I'm guessing another resident complained to the security guard. I had the impression from the article that the security guard was acting in furtherance of the condominium association's "no decoration" policy in confiscating the flag. The condo board also fined him twice - one fine for each time he flew the flag in violation of the "no decoration" policy.

I have some personal experience with THIS exact subject and Florida Law...
The ONLY recourse for the association, or ANY landlord for that matter, is to initiate Legal Proceedings once they wish to further their position beyond the levying of fines..
THAT comes directly from the State of Florida's Attorney General's office as of 2001..
In ANY event,, ANY legal confiscatory action, FOR ANY REASON such as the recovery of stolen goods MUST be done in the presence of a Duly Sworn Officer of the Law and accompanied with a specific COURT order to do so...

NOT a Security Guard...

We do know now that he can fly his flag, the HOA was not stupid, thay accuatly had a brain.
As we know, there are other HOA's that to date, feel thatpatriotism is a crime. They should be abolished and new member elected.

Certainly anyone should be allowed to fly the flag and in fact at this particular condo, flags will now be permitted on the 4th of July and other patriotic holidays.
It is a shame the condo organizations feel they have the right to play God and act as though it is an offenses to fly our flag.
The security guard was well and truly out of hand.

I'm happy to see that the Condo Association wants to correct their error. HOWEVER......

They need to fire the IDIOT guard that broke the flag and threw it on the ground. Brave men and women FAR BETTER than him have fought and died to protect the flag and he obviously has no respect for it.

SHAMEFUL.....
